2021 MOORING LICENCE AGREEMENT

 
1. Preference will be given to boats under 30 feet.
2. Mooring holders must be Ordinary or Cadet members of the Club and must have a majority or equal ownership in the boat.
3. The licence is for 10th April 2021 to 31st October 2021 and is issued subject to payment of the relevant fee.
4. Mooring holders will co-operate with and take instructions from the Harbour Committee and the Club Boatman as representatives of the Club Committee.
5. A ferry service will be operated to a time schedule laid down by the Harbour Committee and displayed on the Club Noticeboard.
6. The mooring holder shall adequately insure the craft against damage to third parties. The Club and the Harbour Authorities shall have no responsibility whatsoever in the event of any damage, loss or injury being caused to any yacht or to any person or property therein or for any third party liability or any other liability that may arise either directly or indirectly from any defect in the mooring provided by the Club or from any other cause whatsoever. A minimum third party cover of €2,000,000 is required. The mooring holder will include a copy of the current insurance schedule with the annual licence application. If the applicant fails to provide evidence of the required insurance the application will not be completed. It is the responsibility of all mooring holders to check that only bona fide sub-contractors are used when carrying out any works on their vessels. For the avoidance of doubt a bona fide sub contractor is a person or company that has adequate insurance cover including but not exclusively Employers Liability / Public Liability and supply of Labour & Materials. 
7. The mooring license shall at all times remain the property of the Club.  The Club shall be entitled at any time and from time to time to terminate the licence for the use of the mooring but in that event the Club shall use its best endeavours to provide an alternative mooring, if this is not possible then the Club shall be obliged to return a proportionate of any mooring fee paid.
8. The mooring holder shall notify the Marina Office of any intended period of absence from the mooring and the Club shall be entitled to use the mooring as it sees fit during this period.
9. The mooring holder shall provide a suitable bridle and substantial shackle for the mooring. It is the mooring holder’s responsibility to ensure that the bridle is securely attached to the mooring.
10. The mooring holder shall ensure that his/her boat is properly moored and does not cause interference or damage to other boats.
11. The Harbour Committee shall have the right to terminate or refuse to renew this licence if, in the opinion of the Harbour Committee, 'reasonable use' has not been made of the yacht using the mooring.  Such decision regarding 'reasonable use' is at the sole discretion of the Harbour Committee.
12. A licence is issued subject to the conditions as laid down by the Harbour Authorities on behalf of the Dept. of Agriculture, Fisheries & Food as well as the above listed Conditions, the Bye - Laws and Regulations of Howth Yacht Club.
